ABOUT BUYERS OF LEADS:

• You choose which leads you want to buy and there is no obligation to buy.
• All contact information that you need, you will automatically get access to right after your purchase.
• The lead information purchased from Fixido is for your use only.
• You are not allowed to distribute the lead information to any other part.
• You are only allowed to contact the lead information consumer regarding the purpose specified in the lead information.
• As Lead Buyer you must have a registered company and approved certificate and no unpaid debts.
• You are not allowed to offend or in any other way harm the consumer you contact. Be fair!

ABOUT SELLERS OF LEADS:

• The lead information sent to Fixido system must be legal, accurate, true and collected in a proper and legal way.
• You are not allowed to send any Lead information to Fixido that offend any laws.
• You decide the price and we take care of the transaction.
• We charge you a 30% commission for each sold lead.

Please read these terms of service carefully before you start to use the site. We maintain this service (website) as a platform for clients (Lead Sellers and Lead Buyers) to exchange information. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of service, please refrain from using our site.

RELIANCE ON INFORMATION POSTED & DISCLAIMER

The materials contained on our site are provided from Lead Sellers and Fixido do not claim to be or constitute legal or other professional advice.

Fixido do not accept any responsibility for any loss which may arise from accessing or reliance on the information on this site and to the fullest extent, we exclude all liability for loss or damages direct or indirect arising from use of this site.

Fixido checks and verifies information about conveyed leads, but still cannot guarantee that all information is correct.

Fixido.com is a site operated by Fixido AB ("We"); we are a Company registered in Sweden under registration number 556885-1850. Our registered office Fleminggatan 20A, 112 26 Stockholm. Our VAT number is SE556885185001.

PARTICIPATION IN SERVICE

You agree that, if you register at Fixido, you will accept our terms and conditions, and any other surviving agreement between you and Fixido. So long as you remain a registered user of Fixido, you are able to buy Leads from Lead Sellers subject to this Agreement and other rules and requirements set forth by Fixido on the Website. You need to be 18 years old minimum to register and use our service.

INTRODUCTION TO A LEAD

Fixido enables the exchange of information about potential customers who have shown an interest in any product or service (a "Lead"). A "Lead" is defined as a request made by a consumer for a product or service. Participants in the Fixido service include "Buyers" and ”Sellers" of leads. Each Lead “Seller" uses the Fixido service to market and sell Leads. Each Lead “Buyer" uses the Fixido service to search for and/or purchase Leads from Lead Sellers.

PAYMENT

It’s free to register on Fixido, both as buyers (Leads Buyer) and Sellers (Leads Sellers). To become a Seller Leads, you must also apply separately. There are no annual or fixed periods for Lead Buyer at Fixido.

As lead buyers need to hold a company which is registered and approved (certificate) and no unpaid debts.

Leads Buyer can deposit money into their Fixido account using a credit card, bank transfer or a valid coupon obtained from Fixido or any of our partners. The money remains in your Fixido account until you use them or terminate your membership, with a time limit of 24 month (2 years). There are no additional fees or subscription fees of any kind. Your entire deposited amount can then be used to buy leads.You can also register as invoice customer. As a customer invoice, you get a credit and can trade requests. At the end of each month or when your credit is over you will receive a monthly invoice. We have 30 days credit on the invoice and payment shall be made to our bank account. The invoice is sent electronically to your email address as an attached PDF file.

Have you received an amount paid to your account from a voucher from Fixido or our partners, there may be special conditions regarding this amount. Often it is a time limitation applicable and the money you received must be used before this time expires. If nothing is written about the time limit, you must use the amount you received via coupon and the like within 3 months or it will expires.

When you want to buy one lead you pay the price indicated in detailed information about the lead. Payment is made automatically from your Fixido account. You can buy directly (click the Buy button) and the money is deducted directly from your account, or you can buy with our shopping cart (click on the “Add to cart” link) function where the money is deducted from your Fixido account only after you confirm the order at checkout. You can also pay through an auction process. If you use the auction you place bids manually or by a subscription. All bids are binding and the highest bidder wins the auction and will automatically get the lead information sent via email. The auction is closed and cannot be appealed.

Leads seller decide the price of their Leads. Fixido charge Leads Buyer according to the price set by the Lead Seller (as seen on the side) + possible applicable Tax and VAT.

USE OF LEADS AND INFORMATION ABOUT LEADS

You agree that you will use Leads consistent with the terms and conditions of this Agreement, the rules posted on the Fixido website, and all applicable laws and regulations. You further agree that you will not knowingly allow any person or entity to misuse Leads, and will alert Fixido immediately upon discovering any misuse or potential misuse of any Lead or Lead related information from Fixido. You agree that you will only contact the person or company stated in the lead information regarding the purpose specified in the lead information. You agree to not offend or in any other way harm the persons you contact.

THE MISUSE OF LEADS MAY RESULT IN THE END OF YOUR ACCOUNT, LOSS OF ALL ACQUIRED LEADS, CIVIL ACTION, CRIMINAL CHARGES, AND/OR ANY OTHER REMEDY AVAILABLE IN EQUITY OR AT LAW.

CONFIDENTIALITY OF LEAD DATA

You pledge and agree that throughout the term of this Agreement, you will not sell, offer to sell, exchange or else handover to any other party any lead information bought from Fixido Services.

OUR SITE CHANGES REGULARLY

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

OUR LIABILITY

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

• All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
• Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for:
• loss of income or revenue;
• loss of business;
• loss of profits or contracts;
• loss of anticipated savings;
• loss of data;
• loss of goodwill;
• wasted management or office time; and

for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

REPORT AND COMPLAIN

You have the right to report and complain on lead information by filling in a form on the Lead Pages. Fixido cannot guarantee you that we will take any action about your report or complain. Fixido has the solely right to decide on actions regarding your report and complain.

INFORMATION ABOUT YOU AND YOUR VISITS TO OUR SITE

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

CHANGE OF SERVICE

The Service, content of the Service, and the functionality, can be altered, detached or added at any period. Fixido is never accountable to pay compensation for modifications in the Service. Notices of changes in the Service can be made public on the Service.

UPGRADES, SUPPORT AND NOTICES

From time to time, Fixido will, and retains the right to, send you information and offers about upgrades, documentation and other services offered by Fixido and its Partners. Nevertheless the foregoing, under no conditions will Fixido or any of its Partners have any commitment to provide you with upgrades, enhancements, modifications, or support for the Fixido Services or related Services.

JURISDICTION AND APPLICABLE LAW

The Swedish courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Sweden.

Fixido is a Swedish registered trade mark of Fixido AB.

VARIATIONS

We may revise these terms of service at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you.
